These Terms and Conditions apply to your use of this website and any order you place with us.
Employee Benefits Program and Presidential Card, both divisions of MEMBERBenefits Pty Ltd (referred to in these Terms as “we”, “our” and “us”), manage and facilitate this employee benefits program, including the provision of eGift cards made available for purchase directly through the Online Shopping section of this website. “You” means you, the employee/member and customer.
1. Scope of Supply

We only sell and supply eGift cards directly.

All other products and services offered through this website are provided by third-party providers. Purchases made directly with providers are subject to the provider’s own terms, conditions, and refund policies. We do not supply those products or services and are not responsible for their quality, accuracy, safety, suitability, or any advice given in connection with them.
2. Placing an Order
When you place an order for an eGift card:

You make an offer to purchase the card based on these Terms and Conditions.

We will confirm your order and issue an order number by email once payment is received and validated.

We reserve the right to refuse service, cancel orders, or restrict accounts at our discretion.
3. Payment

We accept BPAY payments only. Payment details are provided with your order confirmation.

Orders are not considered final until payment is received in full.
4. Gift Cards

eGift cards should be treated as cash. Lost, stolen, or damaged cards cannot be replaced.

Each eGift card is subject to the terms and conditions of the issuing provider. You should review those terms before use.

We are not responsible for:

how or where a provider accepts or honours a card,
-
provider products or services purchased with the card, or
-
any disputes between you and the provider.

5. Consumer Guarantees
Our eGift cards come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any reasonably foreseeable loss or damage. You are also entitled to have eGift cards replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
For provider-supplied goods or services, consumer guarantees are the responsibility of the provider, not us.
6. Our Liability
To the extent permitted by law:

We are not liable for any products, services, or advice provided by third-party providers.

We are not liable for any loss of income, profits, data, or any indirect or consequential loss.

Our maximum aggregate liability in relation to an eGift card you purchase from us is limited to the amount you paid for that card.
7. Data Use and Privacy
By placing an order, you agree that we may store and use your personal information for the purposes of processing your order and managing your account. For details, please see our Privacy Policy.
8. General

You must be at least 18 years of age to place an order.
